Miller Victory for Monsanto Named a Top Defense Verdict
Adam E. Miller’s trial victory for Pharmacia Corporation (formerly Monsanto Company) in Dauber v. Monsanto was named among Courtroom View Network’s 2016 list of Top 10 Defense Verdicts, occupying the number 2 slot. Capes Sokol Shareholder Adam E. Miller represented Monsanto in the trial that took place this past spring in a Los Angeles County, California state court.
The suit stemmed from two individuals seeking $15 million plus unspecified punitive damages who claimed their non-Hodgkin’s lymphomas were the result of food chain and environmental exposures to polychlorinated biphenyls, or PCBs. Monsanto successfully argued that existing medical and scientific evidence fails to support a link between PCBs and the development of non-Hodgkin’s lymphoma in humans and that during the entire 50-year time period during which Monsanto manufactured PCBs, the company acted responsibly to test PCBs and warn customers of potential health risks associated with their use.
The Dauber trial represented the third time a state court jury cleared the company of responsibility for cancer that plaintiffs claimed was caused by PCBs. Adam also represented Monsanto in both of these prior defense verdicts, one of which was tried in Los Angeles County, California, and the other in St. Louis County, Missouri.
